Ebook Terms of Use; Disclaimers and Liability Limitations

  1. The Copy is provided for your personal non-commercial use only, and on a limited basis, in accordance with these terms of use, and the copyright laws of the United States and other jurisdictions.
  2. You will not, and will not permit others to:
    • (a) modify, publish, transmit, or display the Copy in whole or in part, or prepare derivative works based on it, except as expressly provided in these terms of use and except in ways which qualify as "fair use" under U.S. copyright law (Section 107 of Title 17 of the United States Code) ("U.S. Fair Use").
    • (b) post the Copy to Usenet, or any third party website, or provide the Copy to others by any other means, such as an intranet system, a public or private hosting service, peer-to-peer sharing, or RSS feeds, except as specifically authorized by this TOS, or as permitted under U.S. Fair Use; and/or

Distributor and its content providers reserve all rights not expressly granted in these terms of use. Distributors or its content providers own the title, copyright, and other intellectual property rights in the Copy. You must not remove or obscure any copyright or other proprietary notices that appear on the Copy.
  4. The Copy may contain inaccuracies and errors. Use of the Copy and its contents are at your own risk. Distributor and its content providers disclaim all warranties with respect to the Copy other than those expressly stated in these terms of use, such disclaimed warranties including but not limited to implied warranties of merchantability, fitness for a particular purpose, reliability or availability, accuracy or completeness, lack of viruses, and/or lack of negligence.
  5. Distributor and its content providers shall not be liable for any special, incidental, punitive, indirect, or consequential damages (including without limitation damages for lost profits or loss of confidential or other information) arising out of or in any way related to the use of or inability to use the Copy, even if Distributor or any content provider has been advised of the possibility of such damages. Because some jurisdictions do not allow the exclusion or limitation of such damages, this limitation may not apply to you. The entire liability of Distributor and any of its content providers with respect to any Copy, and your exclusive remedy, is limited to refund of the amount that you paid for the Copy. Under no circumstances shall Distributor or its content providers be liable for any delay or failure in performance resulting directly or indirectly from acts of nature, or other causes beyond its reasonable control, including, without limitation, Internet failures, telecommunication equipment failures, fires, floods, etc.
