Summary: Software designs, algorithms, and code all require a great deal of effort and investment to create, and U.S. law – including the U.S. Constitution – provides mechanisms for software engineers and their organizations to retain intellectual property (IP) rights in their creations. IP rights allow software developers to protect and monetize their ownership over the valuable products of their hard work and ingenuity. Such IP rights are essential for incentivizing investment in software R&D, rewarding inventors and entrepreneurs whose products benefit society, and fostering open-source and free software ecosystems.

 Unfortunately, many software engineers have little understanding of the legal mechanics of software IP and fail to take simple (but essential) steps necessary to protect IP. In this one-hour webinar, you will learn about three essential types of software IP: patents, copyrights, and trade-secrets. You will gain an understanding of what each type of IP can and cannot protect. You will learn what rights you have in your IP and what you need to do to establish and retain those rights. You will also develop a sense of how to minimize your risk of infringing the IP rights of others.

 Specific topics covered will include how to file a software patent, how to comply with open-source licenses like the GPL, and how to properly navigate sensitive M&A discussions that involve trade secrets.

Presenter Bio: Dr. George Edwards is the Principal Computer Scientist at Quandary Peak Research and an expert in analyzing software intellectual property (IP). His professional activities include serving as an expert witness in software-related litigation, including patent infringement, copyright infringement, and trade secret misappropriation cases. He has provided testimony as an expert in software analysis and design through formal expert reports, by deposition, and at trial in more than thirty cases.

Quandary Peak Research is a software analysis company with sixteen employees located in Los Angeles, Nashville, Chicago, Austin, Silicon Valley, and Washington, D.C. Quandary Peak’s software analysis services fall into three areas: (1) audits and compliance in highly regulated industries; (2) technical due diligence in mergers and acquisitions; and (3) litigation and intellectual property.  Dr. Edwards holds a Ph.D. in Computer Science from the University of Southern California (USC). He has more than a decade of experience as a scientist, engineer, and technical consultant to academic research labs, government agencies, and technology companies. His academic research has been published in numerous peer-reviewed academic journals and conferences, and he has taught graduate-level software engineering and undergraduate programming courses at the USC. His analysis and opinions on software IP have been filed in state courts, federal district courts, and other venues such as the American Arbitration Association (AAA), the International Trade Commission (ITC), and the Patent Trial and Appeal Board (PTAB).
